Before skydiving anywhere in the world you have to complete a waiver to state that you understand the risks and accept liability. Here are typical extracts that you have to agree with, however please print out the actual form for an up to date copy as above. Assumption of risk waiver of rights indemnity agreement & release of liability In consideration of being permitted to utilise the facilities and equipment of Sky Science & Skydive Spain S L to engage in ground training, skydiving, parachute jumping, powered parachute flying and related activities (Hereinafter collectively referred to as parachute activities) I,________________________________ hereby agree as follows: 1 I agree that parachuting activities, as used in this document include all activities of any nature whatsoever that occur at Aerodrome la Juliana. Initials:__________ 2 I hereby forever release and discharge Skydive Spain & Sky Science S L, all owners of the aircraft, any and all concessionaires of Aerodromo La Juliana, any and all members, offices, directors, employees, instructors, pilots, jumpmasters, tandem instructors, photographers and the owners of the foregoing release parties, the aircraft and land utilised for parachuting activities, from any and all liabilities, claims, demands, or causes of action that I may hereafter have for injuries and damages arising out of my participating in parachuting activities. Initials:__________ 3 I understand and acknowledge that parachuting activities have inherent dangers that no amount of care, caution, instruction or expertise can eliminate and I expressly and voluntarily assume all risk of death or personal injury sustained while participating in parachuting activities including the risk passive or active negligence of the released parties; or hidden, latent, or obvious defects at the airport and the dropzone or in the equipment or aircraft used. Initials:__________ 4 I understand that because of the dangers involved in parachuting activities, the released parties are making no warranty of any kind, express or implied, concerning any and all equipment, aircraft, or facilities provided by the released parties. Initials:__________ 5 Parachuting activities can be dangerous and associated equipment such as parachutes and aircraft do not always work the way they are expected to function. I understand that the parachuting equipment provided by the released parties is provided without any warranty that they are fit for use for any purpose whatsoever. They are provided without any warranty of merchantability or airworthiness. I understand these disclaimers and I accept them. Initials:__________ I am fully aware of the hazards of skydiving & powered parachuting and accept all risks associated with skydiving. Initials:__________ I hereby certify that I do not suffer from any physical infirmity or chronic illness including, but not limited to hearing problems or vision problems which would affect my ability to engage in parachuting activities. I further certify that I am not on any medication and have not taken any alcoholic beverages or drugs within the last twelve (12) hours. I also recognise that it is against Skydive Spain S L rules and regulations to take either alcohol or drugs before participating in parachuting activities and I agree to refrain from doing so. I HAVE CAREFULLY READ THIS AGREEMENT AND RELEASE OF LIABILITY, I FULLY UNDERSTAND ITS CONTENTS AND SIGN IT OF MY OWN FREE WILL Dated:_____________ Signature:______________________ Notes Skydive Spain S L & Sky Science and its staff are all members of The British Parachute Association and all training and systems in place are based on its operations manual as approved by the UK CAA. Skydive Spain S L & Sky Science and its staff are all members of the USA Powered parachute association Aero Sports Connection (ASC) and all training and systems in place are based on its operations manual as approved by the USA FAA. Although statistics prove skydiving and powered parachuting to be nothing like as high risk as some people may perceive, it can never be entirely risk-free, as with any action sport. The risk is reduced to an acceptable level by strict operational procedures but can never be entirely eliminated. Skydivers and Pilots must therefore voluntarily accept an element of risk. However it is prudent to always insure against any risk and a list of
companies who insure against skydiving accidents is available on request. |
